Workplace Safety and Insurance Board Appeals

The Workplace Safety and Insurance Board (WSIB) administers compensation and no-fault insurance for Ontario workplaces. The WSIB operates under its own administrative guidelines for determining the eligibility of workers for the compensation benefits it administers. Appeals of final WSIB decisions are heard by the Workplace Safety and Insurance Appeals Tribunal (WSIAT) which is a separate and independent adjudicative institution from the WSIB. Individuals who want to appeal a final decision of the Workplace Safety and Insurance Board must provide notice of their appeal in writing to the Workplace Safety and Insurance Appeals Tribunal, and indicate why the decision is incorrect or should be changed. An appeal must be filed with the Tribunal within six months after the Board’s final decision (usually from an Appeals Resolution Officer). WSIAT appeals may be held through an oral hearing, mediation, or written submissions.
